1. Privacy
1.1. Your privacy is very important to us here at designernexus. The only details we store are your profile, project information, email and password. Designernexus ensures you that the details store will not be shared with anyone (see part 11 & 12) unless we're forced to by law. All your details are stored on a secure server with a trusted third party hosting provider.
2. Ownership Of Content
2.1. You own all of the content and information you post on designernexus, every design project you post on designernexus is time-stamped to ensure your copyright to the design. Which includes the following commitments:
2.2. You will not post anything you have not designed yourself.
3. Safety
We do our best to keep designernexus safe, but we cannot guarantee it. We need your help in order to do that, which includes the following commitments:
3.1. You will not send or otherwise post unauthorized commercial communications to users (such as spam).
3.2. You will not collect users' information, or otherwise access designernexus, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
3.3. You will not upload viruses or other malicious code.
3.4. You will not solicit login information or access an account belonging to someone else.
3.5. You will not bully, intimidate, or harass any user.
3.6. You will not post content that is hateful, threatening, pornographic, or that contains gratuitous violence.
3.7. You will not use designernexus to do anything unlawful, misleading, malicious, or discriminatory.
3.8. You will not facilitate or encourage any violations of this Statement.
4. Registration and Security
Designernexus users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
4.1. You will not provide any false personal information on designernexus, or create an account for anyone other than yourself without permission.
4.2. You will keep your contact information accurate and up-to-date.
4.3. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
5. Protecting People's Rights
We respect other people's rights, and expect you to do the same.
5.1. You will not post content or take any action on designernexus that infringes someone else's rights or otherwise violates the law.
5.2. We can remove any content you post on designernexus if we believe that it violates this Statement.
5.3. If we removed your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
5.4. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
5.5. You will not use our copyrights or trademarks.
6. Termination
If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of designernexus to you. We will generally try to notify you, but have no obligation to do so. You may also delete your account or disable your application at any time. In all such cases, this Statement shall terminate, but the following provisions will still apply: 2.1., 2.2.,3.1., 3.2., 3.3., 3.4., 3.5., 3.6., 3.7., 3.8., 4.1., 4.2., 4.3., 5.1., 5.2., 5.3., 5.4., 5.5.
7. Payment
7.1. When you confirm a transaction on designernexus, you agree to be bound by and pay for that transaction.
7.2. Pay attention to the details of the transaction, because your total price may include taxes and fees, which you are responsible for paying.
7.3. Don't commit to a transaction unless you are ready to pay, because all sales are final.
8. Withdrawals
When one of your designs wins a contest the money will be send to your account balance, from here you can send it to your personal bank account. The following terms apply:
8.1. A withdrawal from designernexus to your personal bank account may take up to 14 working day.
8.2. There is a 5% withdrawal fee.
9.Design Copyright
If any of the following conditions (9.1.,9.2., 9.3.) are broke its in the designers hand to take action.
9.1. You may declare a winner of your contest before you publish the design.
9.2. Contest holders can only use a design if they have payed the designer.
9.3. Designers can not use someone else's design as their own.
10. Contests
After creating a contest the prize money will be held by designernexus until a winning design is chosen. We suggest that you try and promote your contest as much as possible to get the best results.
11. Supplying The Winning Artwork
After winning a contest you will receive a message from designernexus with the contest holders contact details. You will use them to send the artwork. This includes the following commitments:
11.1. You must not share the contest holders contact details without their permission.
11.2. You must sent the file in Vector format, Adobe Illustrator file or Adobe Photoshop file.
11.3. MOST IMPORTANTLY, MAKE SURE THE CONTEST HOLDER IS HAPPY WITH THE FILE GIVEN.
12. Getting Your Winning Artwork
After you have chosen a winner you will be sent a message with the designers contact details, and the designer will be sent a message with yours. The designer will then sent you the artwork.This includes the following commitments:
12.1. You must not share the designers contact details without their permission.
12.2. MOST IMPORTANTLY MAKE SURE YOU'RE HAPPY WITH THE ARTWORK SUPPLIED.
13. Refunds
If you are not happy with the designs that have been received by the end of your contest you have a choice of two options: 13.1. You can extend the competition for another 20 days and receive more designs. 13.2. You can get your prize money refunded. The refund will be payed into your designernexus account balance and from there you can transfer the money to your bank account.
Once you have selected a winner of your contest (you're happy with the designs received) you have no rights to a refund.
14. Storing Customers Bank Information
Designernexus at no point stores their customers bank information.
15. Definitions
1. By "designernexus" we mean the features and services we make available through our website at www.designernexus.com.
2. By "us," "we" and "our" we mean designernexus Ltd.
3. By "content" we mean the images, videos and information you post on designernexus.
4. By "post" we mean uploading on designernexus or otherwise make available to view.
